Married to "Kimberly" a mere five days before deployment to Iraq, a Minnesota guardsman signed over power of attorney at his young bride's request...he was 36, she was 26.

He came home to a cleaned-out bank account, divorce papers and Kimberly living with her new boyfriend.

A Minnesota National Guardsman is suing his estranged wife and her boyfriend after she allegedly squandered his Active Duty pay while he was serving in Iraq.

According to documents filed Jan. 25 in Johnson County, Kimberly Scullen, 26, of Swisher, spent nearly all of the money her husband, Andrew Scullen, 36, of Hastings, Minn., earned while he was in active duty with the National Guard.

According to the 13-count suit, the Scullens were married on March 10, 2006. Five days later, Andrew Scullen was deployed to serve in Iraq. While serving, Scullen granted his wife power of attorney at her request.

After granting her power of attorney, Kimberly Scullen allegedly spent nearly all of her husband’s pay he received during active duty, the documents state.

This happens all the time in the military. I saw it happen a couple times while I was in Afghanistan. Unless you're married for awhile prior to joining, or you've been married for awhile(I'm talking like 10 years here)after joining, you're an idiot to give your wife power of attorney. Christ, I've seen guys give GIRLFRIENDS power of attorney. I feel sorry for them, but they obviously didn't follow the warnings of their fellow soldiers. There are alot of golddiggers around military bases that are just looking to trap a guy into marriage. They get the benefits, money, they know he's gone alot so they can screw whoever they want, and if he dies, they get even more. Plus if they get pregnant, he has to pay no matter what, because the army will take it right out of his pay.

yea I really don't think he can get that money back if she had power of attorney...I don't know if theres circumstances that negate that, and even though you gotta feel for the guy, legally I don't think there's much to support his case

What can they change? They certainly warn soldiers about it, but other than that, there's not much they can do.

yeah give them the money but there has to be some way they can take it back if they do somthing like this, u serve in the military and u come out with nothing? and the tramp is living with her boyfriend spending his cash

yes, while morally and ethically wrong, idk if there's a whole lot the law can do in punishing her/getting his money back to him...hopefully, she did something illegal in cheating on him and taking his money, therefore allowing him to get something back

Here's the thing. In a sense, the military has already done something about this long ago. First, you can set up what are called allotments. This means that you go to finance, and set it up so that money is automatically deducted from your check to pay certain bills. So if he had to make say, a house payment, a car payment, and just an example, a cell phone payment, he can set up three allotments so that his bills are automatically payed. That money never gets to the golddigger, because it goes straight to his bills. If he doesn't want to get a power of attorney, but she still needs/wants her own spending money, set up a seperate bank account, and have an allotment go to her account as well. That way, you at least keep some of the money away from her. Hell, if you're not sure you can trust her, set up a seperate bank account for yourself, and have an allotment that goes into that. The Army really shouldn't have to be responsible for your finances, when you have a ton of options to be responsible for them yourself.
