He could, but precursor nominations have been leaning Supporting, most notably the Screen Actors Guild. Thats where he and Winslet (for Reader) both might not get nominated. Votes will be split on whether their roles will be lead or supporting.
But the Slumdog love is so utterly out of control at this point, so he has a good shot at getting in. Its a very good movie, but neither Patel nor Pinto should even be considered for an Oscar Nomination imo.

I'm always curious about the criterion for lead vs. supporting. Is there any basic verbal formula or is it something you have to pick up from precedent?

A lot of Precursor stuff such as the Screen Actors Guild are forced to nominate the person in the category that is campaigned for them by the studio and movie.
The Oscars are different though. Their voters can put a person in whichever category they feel they belong.

Saw Paul Blart: Mall Cop. Corny and dumb. I am beginning to seriously dislike Kevin James as a comedian.

It was entertaining, but then again I enjoy Penn and Teller's ********, as a documentary it was really upsetting and almost, not quite but nearing, Michael moore levels of "I'm right, you're stupid" propoganda. Which is a shame because I used to really like Bill Maher and he's generally a smart guy. Will probably check out the Root of All Evil: The God Delusion since I've been bitching about organized religion sinc emiddle school and I do like me some Lewis Black.

I liked Wanted. If you go in expecting what it is (an unrealistic, over the top action movie, basically a pop corn flick) then I think you'll like it. It does have a nice twist as well.

The twist isn't nice, it's pretty obvious but it is a great unbelievable graphic novel miniseries turned live action action movie, with the exception of that stretch were the action just dies for 20 minutes and they try and put some plot to it that really kills the momentum, granted it picks up really quickly once it gets going again.

You caught the twist from the beginning? Interesting. Because I know that "Wanted" novel fans were not happy with how it played out on the big screen.
