When I heard Lester Munson say that tuition would not be considered taxable incom, I was actually surprises. But then I thought about it. My job paid for my masters. Not a scholarship, they straight up paid for it. I never had to pay taxes on it.

UMass is leaving the MAC after the 2015 season. At this time they do not know what their conference affiliation will be, but are committed to remaining in the FBS (damn well better be with the cost of stadium renovations).

The difference is the tuition is their pay, not a perk of employment.

Regardless, much of America is realizing how stupid it is to punish people simply for possessing a drug that is not as dangerous as alcohol or cigarettes.

So Winston's off-season keeps getting longer according to deadspin.

I'm not going to link it because I closed the tab, but rape culture is just an awful thing. I can handle people who are biased politically and spew garbage towards the other party, but when it comes to things like this I can't stand anyone spewing garbage like "She had it coming" or "that's what college is like" or "do you really think the starting quarterback is going to hear the word no" or "she's lying for attention". It's psychologically haunting and often pushed aside.

I'm not surprised that someone is looking in to the handling of the case. The whole thing was/is terrible.

But hopefully it can bring some attention to how grossly unconstitutional the Title IX requirements are for colleges in handling these types of accusations. It basically creates a kangaroo court with an incredibly low "burden of proof", which is more often than not just the say so of the woman, with the accused actually unable to call supporting witnesses. Title IX is one of the worst pieces of legislation ever passed, but these provisions grossly trump how awful the application towards men's sports became. You nearly enter the Title IX proceeding presumed guilty without being afforded the right to prove innocence. Basically Winston invoking his 5th Amendment rights can be seen as an admission of guilt by silence.

The next issue with the application as it pertains to Florida State, the incident happened OFF CAMPUS. Which in turn should leave the local authorities (Police, State Police, Sheriff's, etc) in charge of the investigation and cut off the school's involvement. The school wouldn't have subpoena power to try and get evidence like the video from outside the club (not that would even be admissible in a T9 proceeding).

So FSU is also changing their iconic football uniforms.....

The Spear will reportedly connect at the back of the helmet, like the Seahawks helmet does. Apparently there will be a Garnet colored helmet with a gold facemask as an alternate uniform along with the Unconquered Black uniforms.

This almost makes me happy NCAA 14 is the last CFB game.

Isn't the Title IX requirement just that the school has to investigate accusations? That seems pretty reasonable to me.

The investigation requires a hearing, the hearing is the problem. Remaining silent CAN be used as an admission under the Title IX hearing. Really let that sink in for a minute. In general you will never find a worse piece of legislation than Title IX, but it was introduced by one of the most evil people ever, so not a surprise it's as evil as him.

So don't remain silent? At that point it's basically a civil, not criminal matter, correct?

If you don't, the comments you make can be used against you in a criminal proceeding. Just like they could if you admitted anything under oath in a civil proceeding. You should always be able to completely invoke Constitutionally granted rights when due process kicks in (which it does with FSU being a public university).

This isn't like a military tribunal where Officers are compelled to testify, and then protected because the statements are not ruled to be voluntary.

Think about it, the admission to consensual sex is still an admission to sexual relations, which in itself COULD be enough to get to probable cause for a criminal hearing. The fact the SAO didn't bring forth charges should be the determining factor in absolving FSU in a Title IX issue.

I just love the irony of Title IX being a civil rights based law, while basically stripping civil rights in its implementation.

I gotcha. Sexual assault is a tough situation, though. Two potential victims depending on the situation (rape victim or the falsely accused) so it's more or less a lose-lose. As terrible as it would be to be falsely accused, you have to understand why the rules would lean toward protecting the potential rape victim more. From the statistics I've read, there aren't a lot of false allegations and while it's obviously just an opinion and I suppose would vary case to case, I would say it's typically worse to be raped than falsely accused of rape.

I don't believe it's as much false reporting as it is a double standard. If you are drunk or under the influence otherwise, you cannot consent to sexual intercourse with anyone. Theoretically this means a non-sober man can be raped. When both parties are non-sober then legally it is a double rape (absent an act of force or clear declaration of non-consent). But as a guy if you admit to that, you will be seen as admitting to rape. Women do take advantage of men too, but as a society this is entirely disregarded, especially for female teachers.
